Terms and Conditions of Sale
Article 1: Purpose and Role of Our Payment Partner (Paddle)
These Terms and Conditions of Sale govern the use of and access to digital products (PDF files for learning astrophotography) offered on www.formastro.com by Nicolas ROBERT (Form’astro). Order processing, payment handling, invoicing and tax management (local VAT) are handled by our partner Paddle.com Market Limited (or its subsidiaries), acting as Merchant of Record. By placing an order, the Buyer also accepts Paddle’s terms of sale, which will be presented during checkout.
Article 2: Prices and Taxes
Base prices of our products are listed on www.formastro.com. Since transactions are processed by Paddle internationally, the final price paid by the Buyer may include local taxes (VAT, Sales Tax, etc.) applicable in the Buyer’s country of residence. This final amount will be calculated and displayed transparently by Paddle before final payment validation.
Article 3: Orders and Payment Methods
Payment is due immediately upon ordering. Payment is made through our partner Paddle’s secure platform, which accepts many international payment methods, including PayPal, Google Pay and standard credit cards. The order is final only after payment confirmation by Paddle.
Article 4: Digital Delivery
As the products sold are digital files (PDF), no physical delivery is made. Immediately after payment validation, the Buyer will receive direct access to download their file (either via a confirmation page on the site, or by email containing a secure download link).
Article 5: Express Waiver of the Right of Withdrawal
In accordance with European regulations and Article L.221-28 13° of the French Consumer Code, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium whose performance has begun after the consumer’s prior express consent. By validating their order for PDF files for immediate access, the Buyer expressly waives their 14-day right of withdrawal. Purchases of downloaded digital files are final and non-refundable.
Article 6: Intellectual Property
All content sold on www.formastro.com (texts, images, illustrations, PDF files) is the exclusive property of Nicolas ROBERT (Form’astro). They are protected by international copyright law. Purchasing a PDF grants the Buyer a personal, private and non-exclusive right of use. Any reproduction, resale, distribution, dissemination, translation or making available to third parties, whether free or paid, is strictly prohibited and constitutes counterfeiting subject to legal prosecution.
Article 7: Liability
Form’astro is committed to providing quality educational documents. However, as astrophotography depends on multiple external factors (weather conditions, user’s equipment, light pollution level), Form’astro is bound by an obligation of means and does not guarantee any specific imaging results. Form’astro cannot be held liable for direct or indirect damages related to the use or interpretation of the advice provided.
Article 8: Applicable Law, Disputes and Mediation
These Terms are governed by French law regarding the use of the work and intellectual property (disputes related to payment processing fall under Paddle’s policy). In case of dispute, the Buyer shall first contact Form’astro (contact@formastro.com) to find an amicable solution. If no solution is found, the European consumer may use the European Commission’s Online Dispute Resolution (ODR) platform.
